Under Section 513.653, RSMo, Missouri law enforcement agencies involved in using the federal forfeiture system under federal law are required to file a report regarding federal seizures and the proceeds received through those seizures.
This report shall consist of a copy of the federal "ACA Form - Equitable Sharing Agreement and Certification" (ESAC), which is submitted to the federal government. Under federal law, agencies must annually submit the ESAC in the eShare portal within two months after the end of their fiscal year, regardless of whether funds were received or maintained during the fiscal year. A copy of the ESAC submitted to the federal government in the prior calendar year must be filed with the State Auditor's Office no later than February 15 in the current calendar year.
Under Section 513.653, RSMo, any law enforcement agency that intentionally or knowingly fails to comply with the reporting requirement will not be eligible to receive state or federal funds which would otherwise be paid to such agency for law enforcement, safety, or criminal justice purposes.
